Terms of Use
These terms are an agreement between you and Rocky Dev Co (“we,” “us,” or “our”) about your use of this website. By using the site you accept them. If you do not accept them, do not use the site.
1. What these terms cover
These terms cover rockydevco.com only: the pages you are reading and the client work order form.
They do not cover our software products, the platforms we build and operate for clients, or any engagement with us. Each product has its own terms, and each engagement is governed by the written scope and agreement for that engagement. Where those documents and these terms differ, those documents control for the product or engagement they describe.
2. Using this site
You may use this site to learn about us and to contact us. You may not use it to do anything unlawful, to interfere with its operation, to probe or test its security without our written permission, to submit false or misleading information, or to collect content or contact details from it by automated means for any purpose other than indexing it for a public search engine.
The site is provided for business use. It is not directed to individuals under 18.
3. Work orders and contact
A submission through the work order form is a request, not an order. Submitting the form does not create a contract for services, does not commit us to perform any work, and does not commit you to purchase any.
If we take on the request, we send a written scope. Billable work begins only when you have approved that scope in writing, and the scope and the agreement it references govern the work, not these terms.
When you submit the form or write to us, you confirm that the information you provide is accurate and that you are authorized to provide it on behalf of the company or organization you name.
The work order form is not a secure channel for patient data, health records, or other regulated information. Do not include protected health information, patient identifiers, government identification numbers, financial account numbers, credentials, passwords, or API keys in any field. Our Privacy Policy explains why and what to do instead.
4. What the content on this site is, and is not
The content on this site describes our services, our platforms, and our approach in general terms. It is provided for information. It may be incomplete or out of date, and we may change it at any time without notice.
Nothing on this site is legal, regulatory, compliance, medical, or financial advice, and nothing on it is a representation that any platform or service of ours satisfies a specific legal or regulatory requirement for your operation. Whether a system meets a requirement depends on how it is configured, operated, and validated in your environment, and that is established in writing as part of an engagement, not by a web page.
Descriptions of past work are general and are not a promise that a future engagement will produce the same result.
5. Intellectual property
The site and its content, including text, design, graphics, the Rocky Dev Co mark, and the names of our platforms, are owned by us or our licensors and are protected by copyright, trademark, and other laws. These terms do not grant you any right to use them beyond viewing the site and, where the site offers it, contacting us.
Other names and marks that appear on the site belong to their owners. Their appearance does not imply endorsement in either direction.
If you send us ideas or suggestions about the site or our services, you agree that we may use them without obligation to you. This does not apply to information you provide in connection with an engagement, which is governed by the agreement for that engagement.
6. Third-party sites
The site may link to sites we do not control. We are not responsible for their content, their terms, or how they handle your information. A link is not an endorsement.
7. Privacy
How we handle information submitted through this site is described in our Privacy Policy, which forms part of these terms.
8. No warranty
The site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties about the site and its content, whether express, implied, or statutory, including any warranty of accuracy, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
9. Limitation of liability
To the fullest extent permitted by law, we are not liable to you for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunity, arising out of or relating to your use of the site, however caused and under any theory of liability, even if we were advised of the possibility of such damages.
To the same extent, our total liability for all claims relating to the site will not exceed one hundred US dollars (US$100). This limit does not apply to liability that cannot be limited by law, and it does not apply to an engagement, whose own agreement sets its own terms.
10. Your responsibility for misuse
If your breach of these terms, or your misuse of the site, results in a claim against us by a third party, you agree to defend us against that claim and to cover the losses, costs, and reasonable legal fees we incur as a result.
11. Suspension
We may restrict or suspend access to the site, or any part of it, at any time and without notice, including where we believe these terms have been breached. Sections 4 through 12 survive any suspension.
12. Governing law and disputes
These terms are governed by the laws of the State of Utah, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the site will be brought exclusively in the state or federal courts located in Utah, and you consent to their jurisdiction. If any part of these terms is found unenforceable, the rest remains in effect.
Before either of us brings a claim, we ask that you write to us first at support@rockydevco.com. Most questions are resolved that way.
13. Changes to these terms
We may update these terms. If we make a material change, we will update the effective date and version at the top of this page. Continuing to use the site after a change means you accept the updated terms.
